Contributory negligence

 1990 or so ....

A colleague was chargesheeted for fraud... enquiry held, and dismissed.

The defence representative for charge sheeted employee is from trade union. There wasn't any scope to argue against clear case and evidence. वो bore हो गया, enquiry process में, which was a mere formality. Everyone knew, he will be dismissed.

That neta, used to utilise time for union work in my city( travel on duty, expenses paid by bank ....as a defense lawyer in enquiry 😂). So he asked me "final submission तुम लिखो, मैं sign कर दूंगा"

Force of habit.....😢

I studied the entire proceedings, evidence etc, before framing the "final submission of arguments " on behalf of delinquent employee.

I then described in great detail, the aspect of contributory negligence of the superior officers of that employee. ( every one was complacent about everything in that enquiry, and therefore didnt bother to pay any attention to what I wrote)

"Contributory negligence" is an offence too, in law and it's concepts.

Allow currency notes to pop out of pocket too glaringly, and blame the pickpocket alone?

I didn't know, that....copies of enquiry process goes to RBI, when there is a 'capital' punishment ( dismissal).

RBI has a dedicated department to read all of it carefully 😜

They wrote a very strong letter to headoffice.." why aren't the erring officers not issued a show_cause_notice? For their serious lapse, contributory negligence?.... immediately chargesheet them, send copy to us 😡"

Sudden shock....😂

Head office had no choice.

Officers association ( usually चम्चा of management) connived to send only 'copies' of chargesheet to negligent officers ( who facilitated the fraud, due to their lapses, कामचोर)… original was never served. RBI doesn't ask the results of all chargesheeted cases ( chargesheet देने को बोला, हमने दे दिया! बस………… even shraap, curses, are converted as symbolic नाम के वास्ते 😜, in few cases)

A story of a car owner of denmark, deciding not to move his car till the eggs of a bird in a nest on his car is hatched, became a viral clip on social media, appreciating his humanitarian gesture. 

Here, parking the car for long duration ( contributory act).....bird decided, it is safe to build a nest ....

So, not destroying the nest till the eggs are hatched.... कोई उपकार नहीं किया it was a dharmic duty, only to offset earlier negligence( negligence is .... misleading a bird, that this object is a discarded scrap. 

Even at cellular level.....flab is nothing but a godown constructed by cells in that area of our body..... when we don't use that limb/organ/part of our body for long duration..... contributory negligence of misleading our cellular intelligence 🙏.... when sick, flabby, etc...daaktarr says " walking करो!" Then, people go for "walking करने जा रहा हूं "……… whatever their language, the word "walking" is retained in English...as if it is a generic name of a life_saving_drug, not to be mispronounced or translated😜😂

This "contributory negligence" is very often a series and serious lapse on the part of parents in their upbringing as an act of omission.

result is...... sudden discovery that an offspring does something not in tune with traditions, Dharma etc... Effect is, that generation deteriorates....and over generations, culture, tradition, heritage, values etc evaporate 😜

( values like...... How to learn, how to deepen perception, how to stabilize emotions, how to use sense of 'discrimination'?.... lost 😜😂... सिखाने वाले भी लुप्त)

We often become unaware of several of our acts of contributory negligence ( omission and commision). Like, we suddenly discovered ecology environment etc getting spoiled due to our 'modern' lifestyle 😜
